Terms of Service

These Terms of Service (“Terms”) govern your access to and use of CTG SIM (the “Software”), a cardiotocography training simulator provided by CTG SIM (“we,” “us,” or “our”). By purchasing, installing, or using the Software, you agree to these Terms. If you do not agree, do not use the Software.
1. Training and education only, not a medical device
CTG SIM is a simulation tool for teaching, training, and self-study. It generates artificial, computer-generated tracings and does not measure, record, or interpret any real patient’s condition. It is not a medical device and has not been cleared or approved by any regulatory authority. You must never use CTG SIM for clinical monitoring, diagnosis, treatment, or any decision affecting the care of an actual patient. Nothing displayed by the Software is medical advice.
2. Licenses
Subject to these Terms and your payment of the applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Software:
- Online access (subscription). For the duration of a paid monthly or yearly subscription, you may use the browser-based simulator for your own instructional and educational purposes.
- USB / desktop license. The desktop application sold on a USB drive is licensed to you as a one-time, perpetual license for the individual or institution that purchased it.
You may not resell, sublicense, rent, lease, or redistribute the Software; remove proprietary notices; or reverse engineer, decompile, or attempt to derive the source code except to the extent applicable law prohibits that restriction. Site and multi-seat licenses are available for departments and programs; reach us through our contact form.
3. Subscriptions, billing, and cancellation
Subscriptions are billed in advance through our payment processor, Stripe, at the price and interval shown at checkout. Unless cancelled, subscriptions renew automatically at the end of each period using your payment method on file. You may cancel at any time from your account or by contacting us; cancellation stops future renewals, and your access continues until the end of the period you have already paid for. Prices are in U.S. dollars and may change on a going-forward basis with notice.
4. Refunds
Subscription payments are generally non-refundable except where required by law; when you cancel, you keep access through the paid period. For USB drive orders that arrive damaged or defective, contact us within 30 days of delivery and we will arrange a replacement or refund.
5. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. You agree to provide accurate information and to use the Software in compliance with all applicable laws and these Terms.
6. Intellectual property
The Software, including its code, design, tracings, text, and branding, is owned by CTG SIM and protected by intellectual-property laws. These Terms grant you a license to use the Software, not any ownership interest in it.
7. Disclaimer of warranties
The Software is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or that the simulated tracings are clinically accurate or complete.
8. Limitation of liability
To the fullest extent permitted by law, CTG SIM and its owners and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of, or inability to use, the Software. Our total liability for any claim relating to the Software will not exceed the amount you paid us for the Software in the twelve months preceding the claim. Because the Software is a training tool only, you assume all responsibility for any clinical or educational decisions made by you or those you instruct.
9. Termination
We may suspend or terminate your access if you breach these Terms. Upon termination, your license ends and you must stop using the Software. Sections that by their nature should survive, including licensing restrictions, disclaimers, limitations of liability, and governing law, survive termination.
10. Governing law
These Terms are governed by the laws of the State of North Carolina and applicable United States federal law, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Software will be resolved exclusively in the state or federal courts located in North Carolina, and you consent to their jurisdiction.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above and, where appropriate, by additional notice. Continued use of the Software after changes take effect constitutes acceptance.
